France's F company is a well-known international aluminum industry enterprises, in China has applied for a large number of patents, involving the case of the anode molding machine patent is one of them, the patented technology is mainly used in electrolytic aluminum carbon anode manufacturing equipment, related manufacturing equipment in China's aluminum industry in the field of huge demand. After technological development, a company in Shanghai has also manufactured molding machines that can be used in the same field, and the price is significantly lower than that of Company F. After that, Company F filed a patent infringement lawsuit in Jinan Intermediate People's Court of Shandong Province, claiming that a company in Shanghai constituted patent infringement and claimed nearly 10 million yuan.
After accepting the entrustment of a company in Shanghai, lawyer Mou Xun reviewed and studied the patent technology scheme of French company F, and searched the relevant documents. He found that the patent had substantial defects and did not conform to the relevant provisions of China's patent law. He suggested that a company in Shanghai should start the patent invalidation procedure. The company then entrusted lawyer Mou Xun to file a patent invalidation declaration with the State Intellectual Property Office of China, the Jinan Intermediate People's Court ruled to reject the lawsuit of French F Company.
The victory of this case not only saves the parties a direct loss of nearly 10 million yuan, but also makes the relevant product strategies of the parties unaffected, and the relevant practitioners of the domestic aluminum industry can also choose domestic equipment with lower prices.
