Decoration and renovation projects can be divided into industrial decoration and renovation projects and residential decoration and renovation projects, with the specific target of residential decoration and renovation projects being family residences. Since most family decoration and renovation projects have a small contract amount and a limited scope of work, they generally involve reprocessing of formed spaces and improvements and optimizations of indoor space layout, which do not affect the overall safety structure of the construction project. Therefore, many viewpoints in judicial practice suggest that family decoration and renovation contracts should be classified as contracts for work, and disputes arising from them should be regarded as disputes over contracts for work, subject to the relevant provisions of the Civil Code regarding contracts for work. However, there are also viewpoints that consider decoration and renovation contract disputes as falling under the category of construction contract disputes as defined in the Regulations on Civil Case Causes, and thus family decoration and renovation contracts should also be subject to relevant construction laws. Additionally, some courts, when hearing disputes over family decoration and renovation contracts, either avoid addressing the nature of the contract or acknowledge it as a contract for work while still partially applying relevant construction laws. The author of this article, through empirical analysis of relevant judicial rulings and a review of practical viewpoints, believes that the essential differences between contracts for work and construction contracts should be used as the basis for determining the nature of family decoration and renovation contracts, while also responding to issues of legal applicability based on the legal principles underlying construction law.
