Recently, the design patent infringement case handled by the intellectual property lawyer team of Mou Xun and Ma xugan of our institute was selected as one of the top ten typical cases of patent administrative protection of the State Intellectual Property Office in 2018.
The patentee Jinan Sanxing Lighting Co., Ltd. owns a design patent named "Street Lamp (LED-D133)". It discovered that the Zhonghua Road-Changjiang Road (Renmin Road) section in Heze City, Shandong Province was installed with street lamps suspected of infringing its patent rights, and entrusted the Exchange to safeguard its rights and interests. After accepting the entrustment, lawyers Mou Xun and Ma Xuqian determined through investigation that the street lamp belonged to a municipal project tendered by the government department. The type of street lamp was designed by a design institute and the winning bidder was a company in Heze, Shandong Province. After studying the case, Mou Xun and Ma Xugan's intellectual property lawyer team believed that the infringement of a company in Heze, Shandong Province was established, so they represented the patentee to Heze Intellectual Property Bureau to file a patent infringement dispute settlement request. After the trial by the Heze Intellectual Property Office, it was finally determined that the street lamp manufactured by a company in Heze, Shandong fell into the scope of patent protection, and the infringement was established, and it was ordered to stop the infringement immediately. The typical significance of this case is that the case involves the intellectual property issues of government departments with high social concern in the bidding process.
