On the afternoon of May 28, 2020, the Family and Private Wealth Management Business Committee of the Jinan Lawyers Association and the Jinan High-tech Notary Public Office jointly held the "Seminar on Legal Services of Jinan City's intended guardianship". Lawyer Wang Peng, member of Jinan Lawyers Association's Family Affairs and Private Wealth Management Business Committee and head of Zhongcheng Qingtai's wealth risk prevention lawyer team, attended the meeting together with team lawyers Chen Yuzhong and Liu Wenwen. Lawyer Chen Yuzhong, as a special guest, shared the theme entitled "Research on Implementation of Informed Guardianship Agreement" for the leaders and lawyers attending the meeting.
Based on the newly promulgated the People's Republic of China Civil Code, lawyer Chen Yuzhong first expounds the importance of the voluntary guardianship system from the perspectives of family wealth accumulation, old age yearning for a better life and real risk prevention. Secondly, it focuses on the four legal natures of the voluntary guardianship agreement and the implementation requirements of the voluntary guardianship agreement. Finally, it comes to the actual work of lawyers and puts forward practical suggestions for lawyers to participate in the design of voluntary guardianship agreement. Lawyer Chen's views resonated with the experts and lawyers attending the meeting, saying that Lawyer Chen's research results are of great guiding significance for lawyers to engage in intended guardianship business and promote the landing of service products.
In the near future, the Jinan City Lawyers Association will formulate and promulgate the ''Guidelines for Lawyers' Handling of Legal Services for Wiped Guardianship, ''which is also the first nationwide guideline for lawyers on Wiped Guardianship Legal Services formulated by the Lawyers Association. This type of business provides sufficient practical basis. Through this seminar, the participating lawyers can have a clearer understanding of the application of the new legal service system of intended guardianship in social life, and lay a good foundation for the further promotion of related business products.
Willful guardianship-in accordance with Article 33 of the General principles of the the People's Republic of China Civil Law, adults with full capacity for civil conduct may, in advance, consult with their close relatives and other individuals or organizations willing to act as guardians, determine their own guardians in writing. The guardian determined through consultation shall perform the duties of guardianship when the adult loses or partially loses the capacity for civil conduct. In a broad sense, intended guardianship also includes agreement guardianship, testamentary guardianship, etc. Simply understand, the will is to arrange and plan for one's own affairs in advance, and the intention of guardianship is to prevent the risks that may occur in advance.
