He came from an ordinary peasant family. Reading made him enter the city. Diligence and respect for the law made him a Chinese lawyer. From his first day as a lawyer, he did not forget his true character as a grass-roots lawyer, and was determined to be a qualified and good lawyer who satisfied the people with his actions and loyalty to the law.
In June 2002, he joined Shandong Zhongcheng Renhe Law Firm (the predecessor of Zhongcheng Renhe Law Group (Jinan) Firm). Starting from a trainee lawyer and a paralegal, with a tenacity that never admits defeat, he studied business assiduously and modestly. Learning from his predecessors and peers, in less than five years, in the talented Zhongcheng Institute, he stood out with his serious work attitude, excellent work performance and good professional accomplishment, he has been rated as an advanced worker for consecutive years. At the end of 2005, he was hired as the deputy director of the Financial and Securities Legal Affairs Department and became the backbone of business development and organizational management.
In the past five years of practice, the busy lawyer business has not diluted his simple and fraternity nature, and the continuous improvement of his practice skills and experience has made him even more powerful. He has devoted himself to social welfare activities with a peaceful mind and perseverance, paid attention to the disadvantaged groups in society, and used a sense of responsibility. And caring actions help those in need. Every year, he volunteered to answer legal advice and provide legal assistance to the masses for more than hundreds of times. He worked the most times on duty in the Zhongcheng lawyer of the Jinan disabled Persons' Federation, and the number of legal aid cases he undertook was also in the forefront of the whole institute.
He is Zhang Weijun, deputy director of the Financial and Securities Legal Affairs Department of Zhongcheng Renhe Law Group (Jinan).
In recognition of his outstanding achievements in legal aid work, the Provincial Department of Justice awarded him the "Advanced Individual in Legal Aid" in Shandong Province in 2004. He was the only practicing lawyer in Jinan who received the honor that year; in the same year, he was awarded the "Legal Aid" in Jinan. "Advanced Worker" honorary title.
Perfecting one's personality in helping the disabled and the needy
Protecting the legitimate rights and interests of vulnerable groups is a social problem that must be faced and solved in Chinese society at present, while the rights protection of disabled people is becoming more and more prominent. Due to historical and social reasons, there are still discrimination and prejudice against disabled people in society to varying degrees, and the phenomenon of infringing on the interests of disabled people still occurs from time to time. In order to actively promote legal education in the legal rights protection of disabled people, enhance the awareness of persons with disabilities to use legal weapons to protect their legitimate rights and interests, so that most persons with disabilities know how to take up legal weapons to protect their legitimate rights and interests. In 2002, the Jinan Disabled Persons' Federation where Zhongcheng is located established Zhongcheng lawyers to assist the disabled. Full-time lawyers are on duty every Wednesday morning to provide legal advice and legal assistance to the disabled.
As a lawyer on duty, lawyer Zhang Weijun actively and punctually arrives at the CDPF to complete his on-duty assistance work every time. Whenever other lawyers are unable to attend the post due to reasons such as appearance in court, he can happily accept the arrangement and be on duty. As a special group of vulnerable groups, the disabled are shocked by their pain, helplessness, helplessness and anxiety. Every time he listened patiently, analyzed carefully and answered carefully. In particular, when receiving visits to those disabled persons who have repeatedly petitioned or lodged lawsuits, he pays attention to the unity of law and social effects, and uses the lawyer's sincere, wise and meticulous legal analysis to make them come with confusion and return with satisfaction. He also said that he would no longer petition or lodge lawsuits, thus reducing the pressure on the disabled to petition for the relevant government departments. Relevant leaders of the Municipal Disabled Persons' Federation have repeatedly praised: "Lawyer Zhang is patient and popular. Every time he comes, there will be so many people consulting, which has helped us a lot".
The disabled Gao Moumou belongs to the first-class disability (highly disabled). His real estate demolition dispute case with relevant departments lasted for five years. After the civil litigation of the first, second and retrial, and the administrative litigation of the first, second and retrial, they were all rejected. The litigation request, Gao Moumou was emotional and extreme in treating this case, and petitioned everywhere. During the petition of the disabled persons' Federation, Gao said excitedly that if the case could not be solved fairly, he would take extreme actions. After listening patiently to Gao's statement, lawyer Zhang Weijun calmed his excitement in time through preliminary analysis and answers based on the evidence provided by him. After returning to the office, he reported to the director. Through analysis and argumentation, he believed that the case was hidden. Therefore, according to the director of the institute, Zhang Weijun, as the host lawyer, went through the legal aid formalities for Gao Moumou. After accepting the task, he carefully studied the materials involved in the case, retrieved and collected relevant laws and regulations, searched for demolition policy documents at that time, and discussed and studied cases with professional lawyers in the institute many times. After understanding the case in detail and fully grasping the evidence and legal basis involved in the case, in more than two months, he repeatedly paid out of his own pocket to go back and forth to more than a dozen relevant departments, such as Jinan demolition Office, Jinan Housing Administration Bureau, and Shizhong District demolition Office. Through repeated communication and coordination, the case has made substantial progress-the relevant departments finally agreed to properly solve the housing demolition and resettlement problem for Gao.
Guo Moumou, a resident of Jinan City, is a middle-aged woman who looks a little old. Her husband Tang Moumou is a disabled person with high paraplegia. Her daughter is also a disabled person with severe low vision in both eyes, and her family is extremely poor. Because of the dispute over the right to use the house, after the end of the court hearing, he refused to accept the judgment and filed a complaint, and the court decided to file a case for review and hearing. To this end, she found Zhang Weijun, a lawyer who had provided her with legal help a long time ago. After learning about her family situation and demands, lawyer Zhang immediately decided to provide legal rights protection services for the disabled, and accompanied Guo to the legal aid center to go through the legal aid filing and approval procedures for her.
In 1991, after Tang Moumou paid 2600 yuan for housing fund-raising to the employer, he lived in the disputed fund-raising bungalow. On January 13, 1995, Tang Moumou paid another fund-raising housing fund of 7500 yuan to the employer and moved into Room 603, Unit East, North Building, Dormitory, No. 49 Dingzishan East Road, Jinan City. On June 16, 2000, the employer carried out the housing reform and sale, and the two sides signed the "Employee Housing Agreement". Tang Moumou returned to the employer the agreed room 603, the east unit of the dormitory north building, and paid the housing reform purchase price of 27500 yuan to purchase room 101, the west unit of the dormitory north building. During this period, Tang Moumou, who had been paralyzed in bed for many years, once wrote to the employing unit the written evidence that "Tang Moumou moved to vacate the bungalow and handed it over to the factory ten days after completing the formalities for returning from illness". However, his family continued to occupy and use the bungalow involved in the case after Tang Moumou went through the formalities for returning from illness. When the house was reformed and sold, the employer adjusted the disputed fund-raising bungalow to the employee Yin Moumou, and the employer and Yin Moumou signed a room allocation agreement. Later, a dispute occurred because Tang Moumou refused to vacate the room. First, the employer sued Tang XX for infringement of rights, and 1. the court of second instance rejected the case on the grounds that the division of houses within the unit and the transfer of houses were not under the jurisdiction of the people's court. After the case was closed, the employer changed its strategy and asked Yin Moumou to sue Tang Moumou for infringement, and 1. the judgment of the court of second instance that Tang Moumou had infringed, and ordered the infringement to stop and vacate the bungalow. In the lawsuit, Tang Moumou died, and his wife Guo Moumou refused to accept the judgment and filed a complaint.
After accepting the assignment of the case, lawyer Zhang carefully studied the case, repeatedly reviewed the relevant legal documents involved in the case, received the parties for in-depth understanding of the situation many times, collected a large number of relevant documents and searched for legal norms, and found that there was indeed a dispute in this case: should the bungalow involved in the dispute be identified as a self-managed public house or a fund-raising house? The nature of the house determines the attribution of rights? If there is a situation of coercion, the legal effect of the word "sick and vacated room" can be denied; the housing dispute caused by the unit's housing allocation is not a dispute that occurs in the process of housing allocation and housing transfer within the unit, that is, it does not belong to the jurisdiction of the people's court? After repeated deliberation, lawyer Zhang determined how to correctly identify the right attribute of the disputed house in accordance with the law-public housing or fund-raising housing, step by step to clarify the improper legal documents in force, formed nearly 3,000 words of agency opinions, and was highly recognized by the recipients. When the court organized the case review hearing, lawyer Zhang fully clarified his agency views and basis based on facts and laws. In the end, although the aid case failed to be revised after the case was filed for retrial, lawyer Zhang's serious work attitude, rigorous work style, and diligent work spirit won the praise of the parties and the praise of the judge.
In the process of lawyer Zhang's practice, he not only provides legal services for many big companies and big bosses, but also provides free legal aid to some weak people who have no right, no power and no money when their own time and energy permit. Therefore, in addition to the legal aid cases assigned by the legal aid center, lawyer Zhang always warmly welcomes those who come to the door and need legal help, and tries his best to provide them with legal aid. To be honest, in order to handle such cases, the business fees will be more or less affected, and sometimes the distribution of time and energy will affect the legal business that can make a lot of money, but he has not regretted it. Lawyer Zhang believes that as a lawyer, we should not only provide legal services for a fee, but also do our best to do something useful and unrequited for the society. When helping others, I am also constantly improving my personality and writing a note of no regrets for my life.
The Practice of Fairness and Justice in Legal Assistance
The parties involved in legal aid cases are vulnerable groups, and it is indeed difficult to provide them with legal services. Especially when the cultural knowledge and legal awareness of the parties are relatively low, in order to let the parties know how to protect their legitimate rights and interests in accordance with the law, they need to be very patient and meticulous.
In the early morning of January 22, 2006, Jinan taxi driver Zhang Moumou was violently robbed by three robbers while driving a taxi. He suffered injuries during the struggle and was hospitalized for surgery for up to 12 hours. The local news media reported on the case several times.
In the legal aid activities of thousands of people in Jinan, Zhang asked for advice. Although the three robbers have been arrested and brought to justice, the investigation stage of criminal proceedings is over, and the procedure of examination and prosecution is entered, Zhang has not been compensated for the material losses suffered by Zhang because of his injury. The Jinan Legal Aid Center filed a case to accept his legal aid application and assigned it to the national outstanding law firm-Zhongcheng Renhe Law Group (Jinan).
When lawyer Zhang was busy sorting out his thoughts for other cases at hand, the institute found him and planned to assign him to provide legal aid to Zhang. It is the duty of a lawyer to undertake legal aid cases. As a lawyer, he has the duty to safeguard the dignity of the legal system, be loyal to the Constitution and the law, and uphold justice. Professional sensitivity makes lawyer Zhang feel that if there is no lawyer's due diligence in the case, some legitimate rights and interests of the victim may not be supported by the court because of the lack of timely claims and lack of evidence. The scene in front of him also deeply touched him: a laid-off worker who was at the age of 4500 has been injured since he was injured, and the disabled limb left by the gangster does not allow him to work; in the dilemma that life problems cannot be solved, Zhang Moumou held tens of thousands of yuan of medical bills in his hand and revealed a face of confusion and anxiety. For this reason, lawyer Zhang did not hesitate to undertake the case and immediately went through the corresponding procedures.
After undertaking this case, lawyer Zhang tried his best to devote himself to this legal aid case for the disabled. As in the past, lawyer Zhang analyzed the legitimate rights and interests of the recipients in this case. In the lawsuit, he claimed that these legitimate rights and interests needed to be collected and submitted evidence, and guided the recipients to collect evidence. At the same time, the case materials and the relevant legal issues involved in the case were studied in depth and detail. On the basis of a comprehensive grasp of the case, lawyer Zhang wrote the criminal incidental civil complaint and carefully wrote the agency opinion.
Lawyer Zhang received the honest and reticent recipient Zhang for many times, provided him with enthusiastic service and assisted him in applying for judicial technical appraisal. Shi Moumou is a rural woman in Zhangqiu. The couple used to work in the taxi business in the urban area of Jinan. An accidental traffic accident encountered by their son changed their family's peaceful life. The son, who lives in his hometown in the countryside, was injured in a traffic accident due to illegal driving of a motor vehicle on his way home from school. After several twists and turns, the cost of treating their son's injuries caused them to sell the taxi and spend their savings. The couple's experience for several years made them physically and mentally exhausted. In order to get justice for their young son who was seriously injured in a traffic accident, the couple refused to accept the 1. judgment of the second instance and filed a complaint.
They found lawyer Zhang because during one of lawyer Zhang's court appearances, Shi was impressed by lawyer Zhang's wonderful court style. after the court hearing, she followed lawyer Zhang out of the court and asked lawyer Zhang to represent her. At that time, lawyer Zhang agreed to provide free consultation for her another day because he was busy with his business trip. After the consultation, they said that they had contacted other lawyers, and they recognized lawyer Zhang and strongly requested to go through the agency procedures to represent them. After learning about their situation, lawyer Zhang could not bear to collect legal fees under their poor circumstances. In order to reduce their burden, he suggested that they go to the legal aid center to go through legal aid procedures. However, Shi was worried that he would not be able to assign lawyer Zhang, whom they admired very much, and hesitated for a time. In order to dispel their fear of assigning others to handle the matter, lawyer Zhang put down his work and accompanied them to Jinan legal aid center to handle the aid procedures.
In the thick case files faced by lawyer Zhang, there are not only one book of cases, but also many times of judicial expertise, as well as the judgment of the second instance of the 1. and the materials of relevant departments, which are hundreds of pages. Lawyer Zhang read and analyzed the papers day and night, and finally found a breakthrough in the case, formed a clear idea of agency, and made agency opinions after communicating with the recipients. Lawyer Zhang believes that legal aid is a glorious and complex work, a project that fully reflects social benefits and has far-reaching significance. Providing legal aid with enthusiasm is an important part of implementing the party's strategy of governing the country according to law and building a socialist legal country, and it is the sacred and glorious duty of the lawyers of the Republic.
