Twelve years later, I flew in to detain the decision, and my lawyer was happy to win the case so that the client avoided administrative punishment.
Recently, our senior partner Zhou Jiakui and full-time lawyer Wang Mei received two successful administrative judgments from the Shizhong District People's Court of Jinan City, Shandong Province. The seventeen-page verdict carried the efforts of the two lawyers and the hopes of the parties.
The general facts of the case: On January 22, 2006, the third person Zhang made an unreasonable request for epidemic prevention fees to the village cadre Wan, which triggered a dispute between Zhang and Wan's brothers, and the beating resulted in Zhang's intentional injury. The case of Wan, the case was tried by the court and a criminal judgment was made in 2006, ruling that Zhang constituted the crime of intentional injury and sentenced to six months in prison, after that, civil mediation was reached in 2007: the case was settled once and the two sides did not pursue each other. However, after 12 years, a public security bureau of the defendant suddenly summoned the two brothers and imposed administrative detention on October 10, 2018.
During the trial of the case, the two attorneys were professional and dedicated. Based on the principle of "no longer a case" and the criminal judgment and civil mediation agreement that had been made, they advocated that the two brothers should not continue to be punished for Wan after 12 years. The procedures were illegal and the application of the law was wrong, on the other hand, a public security bureau of the defendant held that there was nothing illegal in the punishment decision of Wan and Zhang on the grounds that the injury caused by the two brothers had not yet been dealt.
It is the duty of the lawyer to protect the legitimate rights and interests of the parties. In the end, the court supported our lawyer's request and revoked the administrative penalty decision against Wan.
As the host lawyer of this case, although lawyer Zhou is an old lawyer with more than ten years of experience in handling cases, he still attached great importance to it when he received the case, and arranged for his assistant to search for a large number of precedents and regulations, so as to make full preparations for the next trial and safeguard the legitimate rights and interests of the parties to the greatest extent.
