As an invited guest, Meng Fanhu delivered a speech on the topic of "Criminal Compliance from the Perspective of Criminal Defense". Meng Fanhu proposed that although criminal compliance is very popular at present, it should not be fanatical. Even if an enterprise has an effective compliance management system, after entering the judicial process, it can be a reason to prevent the establishment of crimes in the United States, because the U.S. Federal Sentencing Guidelines have deferred prosecution agreements, non-prosecution agreements and sentencing incentive systems to protect them, while China's criminal proceedings do not have similar institutional safeguards, and companies have no incentive to establish criminal compliance. At the same time, lawyer Meng Fanhu pointed out that in the construction of the criminal compliance system, the incrimination standard determined by my country's law is used as the red line for corporate criminal risk prevention, and the reasons for the crime and sentencing opinions are used as the relief methods after the incident. At this stage, It is mainly to strive to reduce the amount of fines for enterprises and maximize their legitimate interests.
