Mr. Li Heng was invited to attend the "Seminar on the Practice of General Contracting Dispute Resolution and Frontier Issues of Referee" and delivered a speech.
On December 15, the seminar on the practice of dispute resolution and the frontier of adjudication of general contracting (hereinafter referred to as "the seminar") was successfully held in zhuquan hotel, Jinan. This seminar is co-sponsored by the Permanent China Construction Engineering Law Forum (hereinafter referred to as the "Permanent Forum") and the Shandong Branch of the China International Economic and Trade Arbitration Commission, and co-organized by the Shandong Mediation Center of the China Council for the Promotion of International Economic and Trade and the Jinan Real Estate Association. About 200 people, including the main representatives of the 10th working group of the permanent forum, guests of Shandong Real Estate Association, representatives of arbitrators of Shandong Branch of China International Economic and Trade Arbitration Commission, lawyers and enterprise legal affairs, attended the meeting.
Lawyer Li Heng, deputy director and senior partner of our institute, as one of the representatives of the 10th working group of the permanent forum, was invited to participate in this seminar and delivered a keynote speech entitled "discussion on some legal issues of the employer in general contracting of projects". This paper analyzes the change of the employer's subject in general contracting of projects and puts forward some referee ideas. Several other representatives of the 10th Working Group of the Permanent Forum, such as Wang Dengshan, Sun Ninglian, Qu Xiaofei, Chen Jie, Chen Xiaobo, Yuan Haibing, Xu Yinzhe and other lawyers, respectively, discussed the impact of bidding on the effectiveness of the EPC contract, the impact of qualification on the effectiveness of the EPC contract, the application of judicial interpretation of construction projects to the EPC contract, the impact of EPC contract risk sharing on the contract price, and the change under the EPC model on the project price. The influence of the project general contracting, the determination of the duration responsibility in the project general contracting, the responsibility of the project quality defects in the case of unconventional project general contracting, and other aspects of the keynote speech. The atmosphere of the seminar was warm, and the theme sharing of the speakers was well received by the participants.
