Recently, the Licheng District People's Court of Jinan City issued a judicial confirmation ruling on an ecological environmental damage compensation case represented by lawyers Yao Huming and Luo Xianghu of Zhongcheng Qingtai Jinan Institute. This case is the first judicial confirmation case of ecological environmental damage compensation in Jinan City.
On December 3, 2015, the General Office of the Central Committee and the General Office of the State Council issued the "Pilot Program for the Reform of the Ecological Environment Damage Compensation System". Shandong Province is one of the first seven pilot provinces. After the expiration of the two-year pilot period, on December 17, 2017, the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council issued the ''Eco-Environmental Damage Compensation System Reform Program'', proposing that starting from January 1, 2018, the ecological environmental damage compensation system will be piloted nationwide., And strive to initially build a nationwide ecological environmental damage compensation system with clear responsibilities, smooth channels, technical specifications, strong guarantees, compensation in place, and effective restoration.
In 2017, the Licheng Branch of the Jinan Ecological Environment Bureau inspected and found that the groundwater of a chemical plant in its jurisdiction had pollution characteristics. After entrusting a third-party agency to test, it was confirmed that the groundwater was polluted. Subsequently, Yao Huming and Luo Xianghu were entrusted to participate in the ecological environment damage compensation case.
The Jinan Municipal People's Government designated the Licheng District People's Government of Jinan City as the work unit of this case. After many times of communication with the compensation obligor, the two parties reached the "Ecological Environment Damage Compensation Agreement" and applied to the people's court for judicial confirmation. The Licheng District People's Court of Jinan City conducted judicial confirmation of the "Ecological Environment Damage Compensation Agreement" in accordance with the "Shandong Province Ecological Environment Damage Compensation System Reform Implementation Plan" and other regulations. At this point, the ecological environment damage compensation case came to an end.
