With the theme of "China's bankruptcy procedure and reorganization practice", lawyer Jin Zhongfu introduced that although bankruptcy liquidation and settlement liquidation are almost the same in terms of purpose and principle, limitation of rights and capacity and property liquidation methods, there are differences in liquidation reasons, liquidation procedures, composition of liquidation group and the role of creditors. At the same time, it was emphasized that the Chinese government is currently introducing more systematic and efficient bankruptcy reorganization procedures.
With the theme of "Dispute Resolution in the Divestment Process of Foreign Investors in China", Director Lan Fei introduced the main path of divestment, common disputes in the divestment process, the choice of dispute resolution methods, and arbitration cases of divestment disputes. At the same time, Director Lan Fei also introduced the disputes of equity transfer, enterprise dissolution and liquidation liability that often occur in the process of foreign capital divestment in China, which are resolved by international commercial arbitration, foreign-related litigation under Chinese law, and the choice of applicable law under Chinese law.
