On December 7, 2022, the 74th Qingdao Lawyers Lecture Hall, sponsored by Qingdao Lawyers College and jointly organized by the Bankruptcy and Reorganization Professional Committee of Qingdao Lawyers Association and Qingdao Administrators Association, was held online. Lawyer Zhang Lixin of Zhongcheng Qingtai (Jinan) Law Firm was invited to give a lecture on the topic of "Discussion on Hot Topics of Pre-reorganization Rules and Managers' Practice.
Pre-reorganization is an act of early intervention, which can strive for more sufficient time for enterprises before the legal time limit for judicial reorganization procedures, and is in line with the common interests of debtors, creditors, investors, interested parties and other parties. it is conducive to the court to improve the trial efficiency of reorganization cases, improve the success rate of reorganization, and play a positive role for the government to resolve local financial risks and effectively rescue troubled enterprises.
Based on the objective reality that there is no legislative basis for the current pre-reorganization, and combined with years of front-line work experience in undertaking bankruptcy practices, lawyer Zhang Lixin introduced in detail the positive significance and core value of pre-reorganization in bankruptcy reorganization from the origin and existing regulations of pre-reorganization, listed domestic and foreign cases about pre-reorganization, and explained in detail the application of pre-reorganization rules and the matters needing attention of administrators in the practical operation of pre-reorganization, this paper puts forward some thoughts and suggestions on pre-reorganization, and finally shares the skills of practical operation and important working documents.
